Interesting talk. Regarding Tyson’s ability to walk around and “display” the copyright-protected tattoo, I’d argue that the first sale doctrine covers his use of that particular embodiment of the work. Reproductions/derivations of the tattoo in film, photos, etc., however, wouldn’t be covered.
